Deze Algemene voorwaarden regelen toegang tot en gebruik van NecrolOggi.com en alle gerelateerde diensten.
Door het Platform te gebruiken, gaan gebruikers akkoord met deze voorwaarden.
1. Definities
Platform means NecrolOggi.com and all related services. User means any individual accessing or using the Platform. Agency means funeral agencies and other verified service providers. Content means any information, text, images, comments, obituary data, business information, or uploads.
2. Over NecrolOggi
NecrolOggi is a memorial publishing platform, a discovery marketplace, and a funeral-related services directory. NecrolOggi is not a funeral home, legal advisor, healthcare provider, flower vendor, or counselling provider, and does not directly provide funeral services.
3. Geschiktheid
Users must be at least 18 years old. By using the Platform, users confirm they satisfy this requirement.
4. Gebruikersaccounts
Users may browse public content, create accounts, publish obituaries, submit condolences, and subscribe to alerts. Users are responsible for account confidentiality, access restriction, and accurate account information. NecrolOggi may suspend or terminate accounts at its discretion.
5. Verplichtingen van gebruikers
Users agree not to publish false obituaries, impersonate others, upload unlawful material, infringe copyrights, harass others, upload malicious software, manipulate rankings or reviews, or misuse the Platform.
6. Publicatie van overlijdensberichten
Users publishing obituaries confirm they have authority, the information is accurate to the best of their knowledge, publication does not violate third-party rights, and publication complies with applicable law. NecrolOggi may remove, reject, de-index, suspend users, or require verification documentation.
7. Moderatie
NecrolOggi may moderate content manually, automatically, or using AI-assisted systems. We aim to review reported content within 24 hours where reasonably practicable and reserve full discretionary removal rights.
8. Reacties en condoleances
Comments are subject to moderation before publication. Users may report comments believed to violate these Terms, and NecrolOggi may remove comments without notice.
9. Openbare indexering
Obituaries are publicly accessible and indexed by default. Families may request de-indexing, deletion, or anonymisation, and NecrolOggi may require verification of identity or next-of-kin status.
10. Familiegeschillen
For disputes about obituary ownership or removal, verified next of kin shall generally prevail, while court orders or legal documentation may override Platform decisions. NecrolOggi may temporarily remove disputed content.
11. Agentschapaccounts
Funeral agencies and providers may create business profiles, advertise services, purchase subscriptions, and purchase featured listings. NecrolOggi verifies business registration and VAT details where applicable, but verification is not endorsement.
12. Abonnementen
Agency subscriptions may be monthly or annual, renew automatically, and include promotional trials. Users may cancel at any time. Except where required by law, subscription fees are non-refundable.
13. Uitgelichte vermeldingen en advertenties
NecrolOggi may display featured listings, sponsored content, and promoted agencies. Sponsored placements may influence ranking and visibility.
14. Betalingen
Payments are processed through Stripe. NecrolOggi does not handle or guarantee transactions occurring directly between users and providers.
15. Diensten van derden
NecrolOggi acts solely as an intermediary discovery platform and is not responsible for provider conduct, service quality, pricing, disputes between users and providers, or external transactions. Users engage providers at their own risk.
16. Intellectuele eigendom
All Platform software, branding, interfaces, designs, databases, and materials are owned by or licensed to NecrolOggi. Users may not copy, scrape, reverse engineer, redistribute, or commercially exploit Platform materials without permission.
17. Licentie voor gebruikersinhoud
Users retain ownership of uploaded content and grant NecrolOggi a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, distribute, index, and promote such content in connection with Platform operations.
18. Copyrightklachten
Copyright complaints may be submitted to privacy@necrologgi.com. NecrolOggi may remove allegedly infringing content pending investigation.
19. Verboden inhoud
Users may not publish hate speech, extremist content, graphic content, false death notices, harassment, spam, illegal material, or misleading commercial information.
20. Uitsluiting van garanties
The Platform is provided as is and as available. NecrolOggi does not guarantee uninterrupted availability, error-free operation, accuracy of user-generated content, or provider reliability.
21. Beperking van aansprakelijkheid
To the fullest extent permitted by law, NecrolOggi shall not be liable for emotional distress, indirect losses, reputational harm, user-generated content, provider conduct, business interruption, data loss, or technical failures. Nothing excludes liability where exclusion is prohibited by law.
22. Vrijwaring
Users agree to indemnify NecrolOggi against claims arising from uploaded content, violation of these Terms, unlawful conduct, or infringement of third-party rights.
23. Beëindiging
NecrolOggi may suspend or terminate access for violations of these Terms, fraud prevention, legal compliance, or security reasons.
24. Overmacht
NecrolOggi shall not be liable for delays or failures caused by events beyond reasonable control.
25. Scheidbaarheid
If any provision is deemed unenforceable, remaining provisions shall remain valid.
26. Volledige overeenkomst
These Terms constitute the entire agreement between users and NecrolOggi.
27. Toepasselijk recht
These Terms are governed by the laws of England and Wales. The courts of London shall have exclusive jurisdiction.
